Refund & Dispute Policy

Effective date: [EFFECTIVE_DATE_PLACEHOLDER]

Last updated: [LAST_UPDATED_PLACEHOLDER]

MotoBidz is an introduction platform. The R1,500 introduction fee is paid by a dealer when a seller accepts that dealer's bid. It pays for the introduction — the release of the seller's contact details — not for a verified vehicle. This policy explains when, and how, that fee may be credited, and how disputes are handled. MotoBidz is not a party to the sale between the seller and the dealer.

Sellers

Sellers never pay MotoBidz anything, at any stage. This policy therefore applies only to the R1,500 introduction fee paid by dealers.

Our default position

The introduction fee is non-refundable by default. It buys an introduction to a seller, not a verified, inspected or guaranteed vehicle. MotoBidz does not verify the seller, the vehicle, or any seller-supplied document — verification, inspection and due diligence are the dealer's sole responsibility. The outcome of the underlying sale, including any issue an ordinary professional inspection would have revealed, is the dealer's risk and is not grounds for a refund.

Refunds are account credit only

Where a refund is approved under this policy, it is issued as account credit toward a future introduction fee only. MotoBidz does not refund cash, does not make any cash payment, and credit cannot be transferred to another party or redeemed for cash. MotoBidz never holds the vehicle purchase price.

Narrow grounds for credit

Account credit may be approved only where, after paying the introduction fee, one of the following applies:

  1. The seller's contact details prove invalid — for example a wrong number, or no response from the seller within 7 days of the introduction.

  2. The seller deliberately misrepresented basic listing facts — specifically the year, make, model, or mileage of the vehicle.

Matters that an ordinary professional inspection would reveal — including mechanical condition, accident history, and finance or encumbrance — are never grounds for credit. Those are the dealer's due-diligence responsibility.

How to claim

To claim account credit, a dealer must apply within 7 days of paying the introduction fee, using the dispute form, stating which ground applies and providing at least two items of supporting evidence. We acknowledge the claim within 2 business days and decide within 5 business days. The decision is final, subject to the dispute process below.

Disputes — material misstatement

Separately from a credit claim, a dealer may raise a dispute where they believe a seller materially misstated the vehicle. Material misstatement includes, but is not limited to: a mileage discrepancy, undisclosed accident damage, hidden mechanical faults, false service-history claims, an incorrect year, make or model, and undisclosed finance or encumbrance. The complete defined list of material-misstatement categories is set out in the Dealer Terms of Service.

A dispute must be raised within 7 days of the introduction (extendable to 14 days in defined cases) and must include at least two items of supporting evidence. Where a physical assessment is needed, DEKRA is our recommended independent inspection partner.

[DISPUTE_DETERMINATION_CLAUSE_PLACEHOLDER — the dealer-favourable 'determination' mechanism. To be supplied/confirmed by MotoBidz's attorney before this page goes live, as it must be reviewed against CPA sections 48 and 51. Do not draft this clause.]

Enforcement

Where a seller or dealer is found to have acted in bad faith, the consequences are suspension or permanent removal from the platform. MotoBidz does not impose monetary penalties.

Changes to this policy

We may update this policy from time to time. The version in force is the one published on this page, dated above.
